"We"/"Us"/"Company/travelxp" means "Travelxp India Private Limited" and our websites “www.travelxp.com

Travelxp India Private Limited (CIN: U63040MH2009PTC191030) is a company registered in India having its registered office at 5th floor, Tech Web Centre, Link road, Oshiwara, Mumbai 400 102, India.

"You"/"Client" means the person / persons / company / institution or anybody, in whose name or on whose behalf the booking is made with us.

Please read these booking carefully. They set out the Terms & Conditions of the Agreement between You and travelxp, where, if we are acting as principal OR with our supplier where we are acting as an Agent.

Relationship between Company and Client: Where you have purchased separate travel components at separate prices sourced from different or the same supplier; any liability for defective services, death, injury or illness caused by either the negligence of the supplier, its agents or subcontractors or otherwise will not be liability of travelxp and will require you to claim against the supplier of the service concerned.

Your relationship with travelxp and whether we are a principal in direct contract with you, or the agent of another party will depend on whether you buy; these terms are defined below and separate booking conditions apply to each type of booking:

1. Tour Operator Packages:

  1. 1.1
    Direct contract with the Tour Operator: If you purchase a Tour Operators Package you will enter a direct contract with the Tour Operator and their Terms and Conditions will apply to your booking. They will advise you to the extent of their liability for the performance of the overseas holiday arrangements and claims for death illness or injury occurring during your holiday.
  2. 1.2
    Liability of your holiday arrangements: Travelxp acts solely as the Agent for the Tour Operator who has organized your holiday. Accordingly travelxp has no liability for the performance of your holiday arrangements which are matters entirely between you and the Tour Operator and their booking conditions.
  3. 1.3
    Booking Conditions: All booking conditions for our featured Tour Operators are available from us on request but will usually be available to you in the Tour Operators brochure or on their website.

2.Package Holiday Offered by Travelxp:

  1. 2.1.
    Package Holiday: This is where you purchase through us holiday packages which are put together by us as a pre arranged combination and sold or offered for sale at an inclusive price. It is not a Package Holiday where you have selected different travel components which you instruct us to combine and which are offered to you separately at separate prices. Should you proceed to purchase the different and individually priced travel components or a combination of them, we will not have sold you a "Package" and we will act only as agents for those suppliers and you will have separate contracts with each supplier of those travel components (flights/transport, accommodation or other tourist services) that you have selected. If we have sold or offered to sell a Package Holiday to you then the following Booking Conditions will apply.
  2. 2.2.
    Your Holiday Contract: When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. If you are booking for a group you are ultimately responsible for paying the holiday invoice, even though by booking on behalf of the group, you are representing that each group member accepts that they are bound by this Agreement. A contract will exist as soon as any payment is received and we issue our confirmation invoice. This contract is made on the terms of these booking conditions and (the both the parties) we both agree to submit to the exclusive jurisdiction of the appropriate Courts situated at Mumbai, Maharashtra, India. You should also refer to our website www.travelxp.com for any updated information or changes concerning your holiday that may have occurred since you booked your holiday and where these conditions are also available.
  3. 2.3.
    Hotels:
    1. 2.3.1.
      Bookings: Hotel bookings are either directly purchased from the hotel or from a supplier at separate prices on the monies you pay us and we are acting as an Agent only, the same will not be protected in the event of either of our or any supplier's insolvency.
    2. 2.3.2.
      Photo- ID’s: Hotels insist on photo-identification of the clients for security purposes. You would have to carry a valid photo identification document issued by the government (e.g. Passport, Driving License etc).
    3. 2.3.3.
      Service issues: In case of any issues with the services at the hotels, kindly inform the reception / duty manager immediately.
    4. 2.3.4.
      Change of Hotels: In some cases, we reserve the right to provide alternate hotels of the same category based on the availability.
    5. 2.3.5.
      Check-in and Check-out Timings: Early check in and late checkout is always subject to availability at the hotel and can never be guaranteed under any circumstances. All baggage and personal effects are at all times and under all circumstances your responsibility. We will not be responsible or liable in case of loss of such items from the hotel premises / coach / Airport / during travel or place of visit etc. Some hotels offer the facility of safe deposit lockers, which can be availed of by you at your own cost and risk. We will not be liable for any loss/theft from the same. Any damages caused to the hotel rooms / Coach / place of visit etc. during your stay / tour / visit, shall be borne and payable by you, and We will not be liable for the same. We shall not be liable if there is sudden disruption/disorder of telephone, internet services, and other amenities while staying at the hotels. We will also be not responsible for the facilities provided or not provided in the room/bathroom/hotel premises etc. by the Hotel or its staff. Rude or Unprofessional behavior of hotel staff does not come under the direct purview of the Company and the Company will not be responsible for the same. Facilities like mini bar, pay television channels, telephone etc are not complimentary and these facilities if used by the Client have to be paid for by the client directly to the Hotel and such charges are not included in the tour cost. The Client will have to abide by the check in /check out time of the hotel. Any changes made directly by the hotel come under their direct purview and We will not be liable for any compensation due to this change.
  4. 2.4.
    Flights:
    1. 2.4.1.
      Bookings: We can book Flight bookings either directly from the Airline or from a consolidator. In any event the liability related to your booking remains with the airline. Details of the airline, aircraft type routing and destination will be given to you when your booking is confirmed. Please note that sometimes it is necessary to change the airline, routing (for example form direct non-stop to indirect with stops) or aircraft type before you travel. These are minor changes and no compensation is payable.
    2. 2.4.2.
      Airline rules: All flights are subject to the airlines own Conditions of Carriage (copies are available on request and also available from the airlines website). These and the Montreal Convention which applies to all international flights, limit the airlines liability to you in connection with death and injury, lost and delayed baggage, missed connecting flights and delayed departures and cancellations of flights.
    3. 2.4.3.
      Delayed or lost baggage: Delayed or lost baggage can cause difficulties whilst on holiday. Liability for all baggage issues lies with the airline that will assist you in seeking to recover your baggage. In the unlikely event that you have these difficulties you should report the problem to the airline upon arrival and they will seek to trace any missing items and advise about the purchase of necessities.
    4. 2.4.4.
      Security Guidelines: You must ensure that you comply with all requests from your airline in respect of security (including giving any advance passenger information required by Governments, and all security measures in place when you travel. You must ensure that you arrive well before the latest check in time for check-in and at the boarding gate. In the event that you are denied boarding by the airline for these reasons travelxp shall have no responsibility.
    5. 2.4.5.
      Seat Allocation: There is no guarantee that you will be given any particular seat or a seat adjacent to others in your party when you board the aircraft, which is at the discretion of the airline.

3. Buses:

Travelxp does not operate bus services of its own. It has tied up with many aggregators and bus operators in order to provide a comprehensive choice of bus operators, departure times and prices to customers,. Travelxp’ advice to you is to select bus operators you are aware of and whose service you are comfortable with.

  1. 3.1.
    Travelxp’s responsibilities include:
    1. 3.1.1. Issuing a valid ticket(a ticket that will be accepted by the bus operator)for its’ network of bus Operators.
    2. 3.1.2. Providing refund and support in the event of cancellation.
    3. 3.1.3. Providing customer support and information in case of any delays / inconvenience.
  2. 3.2.
    Travelxp’s responsibilities do NOT include:
    1. 3.2.1. The bus operator’s bus not departing / reaching on time.
    2. 3.2.2. The bus operator’s employees being rude.
    3. 3.2.3. The bus operator’s bus seats etc not being up to the customer’s expectation.
    4. 3.2.4. The bus operator canceling the trip due to unavoidable reasons.
    5. 3.2.5. The baggage of the customer getting lost / stolen / damaged.
    6. 3.2.6. The bus operator changing a customer’s seat at the last minute to accommodate a lady / child.
    7. 3.2.7. The customer waiting at the wrong boarding point (please call the bus operator to find out the exact boarding point if you are not a regular traveler on that particular bus).
    8. 3.2.8. The bus operator changing the boarding point and/or using a pick-up vehicle at the boarding point to take customers to the bus departure point.
  3. 3.3.
    Timings: The arrival and departure times mentioned on the ticket are only tentative timings . However the bus will not leave the source before the time that is mentioned on the ticket.
  4. 3.4.
    Boarding the bus: Passengers are required to furnish the following at the time of boarding the bus:
    1. 3.4.1. A copy of the ticket (A print out of the ticket or the print out of the ticket e-mail).
    2. 3.4.2. Identity proof mentioned at the time of booking (Driving license, Student ID card, Company ID card, Passport, PAN card or Voter ID card). Failing to do so, they may not be allowed to board the bus.
  5. 3.5.
    Change of bus: In case the bus operator changes the type of bus due to some reason, Travelxp will refund the differential amount to the customer upon being intimated by the customers in 24 hours of the journey.
  6. 3.6.
    Cancellation Policy: The cancellation policy will be printed on the ticket copy and will depend on the bus service provider. The transaction charges will not be refunded.
  7. 3.7.
    Booking Confirmation: In case a booking confirmation email and sms gets delayed or fails because of technical reasons or as a result of incorrect e-mail ID / phone number provided by the user etc, a ticket will be considered 'booked' as long as the ticket shows up on the confirmation page of www.travelxp.com
  8. 3.8.
    Duplicate Ticket: To get a fresh copy of ticket you can write to us on customercare@travelxp.com or also call us on 022 4252 9797 and mention your booking reference no.

4. Hotels:

These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online,or through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the "website") and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below.

  1. 4.1.
    Scope of our Service: Through the website, we an online platform through which all types of temporary accommodations (for example hotels, motels, hostels and bed & breakfasts, collectively the "accommodation(s)"), can advertise their rooms for reservation, and through which visitors to the website can make such reservations. By making a reservation through www.travelxp.com, you enter into a direct (legally binding) contractual relationship with the accommodation provider at which you book. From the point at which you make your reservation, we act solely as an link between you and the provider, transmitting the details of your reservation to the relevant accommodation provider and sending you a confirmation email for and on behalf of the accommodation provider. Any reservations which you make on Travelxp.com will be made on the assumption that you have a valid Indian Nationality, if in case the client does not have a valid Indian Nationality they may get in touch with Travelxp team at the earliest, any changes due to modification of Nationality will be billed to the client.
  2. 4.2.
    Accuracy of Informations: When rendering our services, the information that we disclose is based on the information provided to us by accommodation providers either directly or through aggregators. As such, the accommodation providers are given access to an extranet through which they are fully responsible for updating all rates, availability and other information which is displayed on our website. Although we will use reasonable skill and care in performing our services we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each accommodation provider remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our website. Our website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any accommodations made available.

5. Flights Bookings:

We can book Flight bookings either directly from the Airline or from a consolidator. In any event the liability related to your booking remains with the airline. Details of the airline, aircraft type routing and destination will be given to you when your booking is confirmed. Please note that sometimes it is necessary to change the airline, routing (for example form direct non-stop to indirect with stops) or aircraft type before you travel. These are minor changes and no compensation is payable.

  1. 5.1.

    1. 5.4.1. Issuing a valid ticket (a ticket that will be accepted by the Airline at the Boarding counter on the designated Airport).
    2. 5.4.2. Providing refund and support in the event of cancellation.
    3. 5.4.3. Providing customer support and information in case of any delays / inconvenience.
  5. 5.5.
    Travelxp’s responsibilities do NOT include:
    1. 5.5.1. The Flight getting delayed or re scheduled and as a consequence not reaching the destination on the scheduled time.
    2. 5.5.2. The Airline seats and other equipments not being up to the customer’s expectation.
    3. 5.5.3. The Airline cancelling the departure due to un avoidable circumstances.
    4. 5.5.4. The baggage of the customer getting lost / stolen / damaged.
  6. 5.6.
    Boarding the Flight: Passengers are required to furnish the following at the Boarding counter at time of boarding the flight.
    1. 5.6.1. A copy of the ticket (A print out of the ticket or the print out of the ticket e-mail).
    2. 5.6.2. Identity proof mentioned at the time of booking (Driving license, Student ID card, Company ID card, Passport, PAN card or Voter ID card).Failing to do so, they may not be allowed to board the bus.
  7. 5.7. Booking Confirmation In case a booking confirmation email and sms gets delayed or fails because of technical reasons or as a result of incorrect e-mail ID / phone number provided by the user etc, a ticket will be considered 'booked' as long as the ticket shows up on the confirmation page of www.travelxp.com .
  8. 5.8.
    Duplicate Ticket: To get a fresh copy of ticket you can write to us on customercare@travelxp.com or also call us on 022 4252 9797 and mention your booking reference no.

6. Flight + Hotel:

Travelxp does not own any hotels or Airlines services of its own. Travelxp can do Flight or Hotel bookings either directly or from consolidators. In any event the liability related to your booking remains with the respective airline and Hotel in which the booking is done. Travelxp has tied up with many aggregators, Airlines, Hotels and Consolidators in order to provide a comprehensive choice of services and prices to customers. Travelxp’ advice to you is to make a selection of services you are aware of and whose service you are comfortable with.

  1. 6.1.
    Package Holiday booking: When you purchase a flight and a hotel accommodation with us, under the Flight + Hotel scheme, though you have purchased from us the two components of your travel in a combination jointly at a combined price, the individual bookings of Flights and that of the Hotel will be treated as a package holiday bookings.
  2. 6.2.
    Price benefit: The two components of Flight and Hotel under the scheme are combined only to give you an opportunity to book the two major components of your travel in a bundled manner and to get a benefit on combined discounted price as compared to the total price of the components bought individually.
  3. 6.3.
    Terms of bookings: For Flight bookings under Flight + Hotel scheme, the terms of Holiday Packages mentioned in Clause 2 will apply.

7. Booking Conditions:

  1. 7.1.
    Booking with us: Please read carefully and understand the contents of the Itinerary, the ‘Terms and Conditions’, How to Book Rules, Price Grid and such other documents as may be applicable, as all these will form part of your contract with us once you effect the booking.
  2. 7.2.
    Acceptance of terms: To effect the booking, Company may require you to tick on check box of Agree with the terms & conditions, tick marking on the checkbox means that you have read and understood the terms and conditions. Upon executing the Booking and on payment of the prescribed non-refundable interest-free booking amount, a binding contract shall come into existence.
  3. 7.3.
    Proper representation: Company advises you to ensure, before making a booking, that you have and / or you will be able to provide all the required valid and genuine documents and your professional qualifications to enable you to apply for visa, insurance etc.
  4. 7.4.
    Documentation required: Please go through our web site and check from our staff to ascertain the required documentation. Please note that guests other than tourist are not to be invited on tour by any tourist and they are not allowed to use any of the services of the tour.
  5. 7.5.
    Change in price: We reserve the right to alter the prices of any of the holidays we have advertised. You will be advised of the current price of the holiday that you wish to book before your booking is confirmed. Please see our website at www.travelxp.com for our latest pricing indications and for the latest updates on the facilities and amenities at your selected accommodation and information about our flights and other services.
  6. 7.6.
    Payment on time: Other than where you may book by paying a deposit with a balance of the cost to follow (see below) when you make your booking you must pay the full price you have been given immediately. If for any reason we are not paid on time, your tour shall be deemed as cancelled by you, and we shall cancel your travel arrangements. If you cancel, the cancellation charges applicable as per the type of booking, the same is specified on the website at the time of booking.
  7. 7.7.
    Non Payment of balance money: The price of your travel arrangements are calculated using exchange rates as mentioned in each package for all International destinations. We will advise you at the time of booking if you may pay a deposit to book with the balance of the price to follow or 100 % of the package price. Where a booking is done by payment of deposit, the balance of your travel arrangement cost must be paid by no later than 8 weeks before departure or the time as indicated by our travel counselor, whichever is earlier. If the balance is not paid in time we shall retain and forfeit your deposit. If the deposit and/or balance are not paid on time we shall cancel your travel arrangements. Please see the cancellation charges mentioned in the terms and conditions of the product mentioned on the website at the time of booking.
  8. 7.8.
    Changes in Cost: Changes in transportation costs such as fuel, duties taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports and exchange rates mean that the price of your travel arrangements may change after you have booked. The amount of change will be communicated to you well in Advance and you will have to pay the same at least 7 days before the departure. However there will be no change within 30 days of your departure.
  9. 7.9.
    Telephonic Bookings: Many of our bookings are taken directly by telephone when spelling and other errors may be made. It is a condition of our contract with you that you carefully check our confirmation immediately this is received to ensure that the names of all passengers are correctly spelt and are identical to the names shown in the passport (including the initial or first name), and the dates and time of travel, departure, arrival cities and other relevant information. You should check the confirmation for accuracy and that the travel details match what you have booked. If there is any discrepancy you are required to notify us or your travel agent within 24 hours and to take a note of who you report it to. We cannot be responsible if you do not advise us of any discrepancy unless you follow this procedure.
  10. 7.10.
    Mode of payment: Payments to us are usually required by Credit or Debit card. For payment by Credit or Debit Card you undertake to us that you are at least the age of 18 years and have the authority to use the card or billing account details you provide to us for the purpose of settling any payments you owe to us for the services to be provided to yourself and those other persons named on the booking on whose behalf you are legally entitled to act. Please refer to our Privacy Policy for details of our security arrangements for card and other payment data and the manner in which we keep your personal data.
  11. 7.11.
    Amendments and/ or Cancellations:
    1. 7.11.1.
      If you amend your Booking: Changes in booking are not permitted. However, if there are any changes an amendment fee will be applicable and will be communicated before any changes can be done. The amendment fees will have to be paid by the client before the changes are done. If after our booking confirmation or invoice has been issued, you wish to change your travel arrangements in any way, for example your chosen departure date or accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing (by an email) from the person who made the booking. You will be asked to pay an administration charge of Rs. 5,000=00 per person, and any further cost we incur in making this alteration. You should be aware that these costs could increase the closer to the departure date that changes are made and you should contact us as soon as possible. Where changes are possible we will issue a revised invoice including all additional charges. Any passenger name or spelling changes are not permitted and are treated as a cancellation.
    2. 7.11.2.
      Note: Certain travel arrangements (e.g. APEX / Non Refundable tickets) may not be changeable after a reservation has been made and any alteration request could incur cancellation charges of up to 100% of that part of the arrangements.
    3. 7.11.3.
      If You Cancel Your Holiday: You or any member of your party, may cancel your travel arrangements at any time. Written notification (by an email) from the person who made the booking on your behalf must be received at our offices. Since we incur costs in cancelling your travel arrangements, you will have to pay the applicable cancellation charges mentioned in the product terms and conditions on the website at the time of booking. Please note that some travel arrangements such as APEX or non refundable tickets carry 100% cancellation charges and no refunds can be made.
    4. 7.11.4.
      If We Change or Cancel Your Holiday: It is unlikely that we will have to make any changes to your travel arrangements, but we do plan the arrangements many months in advance. Occasionally, we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor and we will advise you or your of them at the earliest possible date. No compensation or refund is payable where a minor change is made. We also reserve the right in any circumstances to cancel your travel arrangements. For example, if the minimum number of clients required for a particular travel arrangement is not reached, we may have to cancel it. However, we will not cancel your travel arrangements less than 4 weeks before your departure date, except for reasons of force majeure or failure by you to pay the final balance. If we are unable to provide the booked travel arrangements, you can either have a refund of all monies paid or accept an offer of alternative travel arrangements of comparable standard from us; if available (We will refund any price difference if the alternative is of a lower value). If it is necessary to cancel your travel arrangements, we will refund you 100 % amount that you paid to us for booking your holiday. We will advise you of the identity of the airline at the time of booking or when this becomes known to us. Any changes to the actual airline after you have received your tickets will be notified to you as soon as possible and in all cases at check-in or at the boarding gate. Such a change is a minor change. Other examples of minor changes include alteration of your outward/return flights by less than 24 hours, changes to aircraft type, change of accommodation to another of the same standard, or a change to your departure airport. We do not have to tell you about minor changes before you go on holiday and we will not pay compensation. If we make a major change to your holiday, we will inform you as soon as reasonably possible if there is time before your departure. You will have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements from us if available or cancelling your booked holiday and receiving a full refund of all monies paid. If you do not wish to take the alternative we offer you, you can choose another holiday from us and pay, or receive a full refund of any price difference.
  12. 7.12.
    Force Majeure: This means that we will not pay you compensation if we have to cancel or change your travel arrangements in any way because of unusual or unforeseeable circumstances beyond our control. These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions, epidemics and pandemics, unavoidable technical problems with transport. Whilst we will always offer assistance to our customers to ensure their wellbeing and safety we are not responsible for any additional costs or expenses incurred where you might be unable to travel due to the consequences of the Force Majeure.
  13. 7.13.
    For Flight Bookings: In case of amendments or cancellations of flight bookings, the rules and regulations of the respective Airlines apply. Charges, penalties and other charges are levied by the respective Airlines. The same can be obtained from the respective Airlines websites or by calling their Customer Care centre. We make all efforts to display the same on our website, while you are making your booking, however you need to verify the same from the Airlines as well.
    1. 7.13.1. Over and above the charges that Airlines charges as mentioned herein above, travelxp service charges excluding GST shall be applicable, in case of each cancellation as follows:
      Rs. 250 per person per sector for one way domestic tickets.
      Rs. 500 per person per sector for return domestic tickets.
      Rs. 500 per person per sector for one way international tickets.
      Rs. 1000 per person per sector for return International tickets.
    2. 7.13.2 Over and above the charges that Airlines charges as mentioned herein above, travelxp service charges excluding GST shall be applicable, in case of each amendment as follows:
      Rs. 250 per person per sector for one way domestic tickets.
      Rs. 500 per person per sector for return domestic tickets.
      Rs. 500 per person per sector for one way international tickets.
      Rs. 1000 per person per sector for return International tickets.
  14. 7.14.
    For Bookings done with Deal codes or Promotions: travelxp may run promotions with or without Deal codes or also give discounts or offers. In such cases, where the booking is done using one or many of such Promotional offers, deal codes or discounts and the said booking is then cancelled, the amount of discount availed at the time of booking using the offer or deal combined will be deducted over and above the cancellation charges as per policy of the service booked mentioned on the website at the time of booking.
  15. 7.15.
    Refunds: Allthough, travelxp process all refunds arising from any transactions due to any cancellation of the booking or any reason whatsoever within 2-3 working days (after deducting the applicable charges) in the same bank account or debit or credit card used by the Client to make the payment at the time of booking, it may take 15 to 20 days to reflect in the clients Accounts due to the Bank's processess.

8. Restrictions on Commercial Use:

Discounts and offers provided on our platform are strictly intended for personal use by individual travelers only. Accounts identified as engaging in corporate, commercial, or business-related activities, including but not limited to bookings made on behalf of companies or travel agencies, are in violation of our terms. Such accounts may be restricted or permanently deactivated without prior notice. If your account has been flagged or deactivated due to suspected commercial activity, please contact our customer care team at customercare@travelxp.com for further assistance.

9. Liability:

In case of any booking that may incur a technical error or any fare difference due to technology challenges or otherwise arises, we shall be within our right to raise that demand within 48 hours of the booking. In case the difference of amount is not paid, the booking shall be cancelled and the original amount shall be refunded to you without any charge from our side or liability to us. You shall be within your right to pay the difference as demanded and get the booking vouchers / tickets.

Travelxp is not liable / responsible for any damages, costs, expenses, losses, or claims which are attributable to the fault of yours, the unforeseeable or unavoidable act or omission of a third party unconnected with the provision of any services that form any part of the Tour(s), or a Force Majeure event (as defined).

In the event that any deficiency, loss, death, injury or illness is caused by the negligent acts and/or omissions of Travelxp or of the third-party suppliers of any services which form part of the Contract, then Travelxp limits its liability, where applicable by all applicable International Conventions Carriage of Clients and their luggage by sea is governed by the Athens Convention which is expressly incorporated into these Terms & Conditions and any liability of Travelxp and/or the Carrier for death or personal injury or for loss or damage to luggage arising out of carriage by sea shall be determined solely in accordance with this Convention. The Athens Convention limits the Carrier's liability for death or personal injury or loss or damage to luggage and makes special provision for valuables. It presumes that luggage has been delivered undamaged to the Guest unless written notice is given to Travelxp and/or the Carrier:

  1. 1. In the case of apparent damage, before or at the time of disembarkation or redelivery; or
  2. 2.In the case of damage which is not apparent or of loss, within 15 days from the date of disembarkation or redelivery or from the time when such redelivery should have taken place. Any damage payable by Travelxp/ G Adventure up to the Athens Convention limits shall be reduced in proportion to any contributory negligence by the Client and by the maximum deductible specified in Article 8 (4) 01 of the Athens Convention.

10. Jurisdiction:

In the event of a dispute arising out of or relating to this contract, including any question regarding its existence, validity or termination, the parties shall first seek settlement of that dispute by mediation in accordance with the applicable rules. The Mediator shall be appointed by Travelxp. If the dispute is not settled by mediation within thirty (30) days of the appointment of the mediator, or such further period as the parties shall agree in writing, then the dispute shall be settled in accordance with the Arbitration and Conciliation Act, 1996 by a sole Arbitrator to be appointed by travelxp. The Arbitration proceedings should be held in Mumbai. The arbitrator's decision shall be final and binding on both parties. In case of any dispute concerning the award the courts in Mumbai alone shall have exclusive jurisdiction. This contract will be governed by Indian law. You agree that in the event of a dispute or difference between the parties the exclusive jurisdiction shall vest in the competent court / forum / tribunal in Mumbai only.

11. Privacy of Information:

We try to maintain the privacy of the personal information provided by you. However, it would be necessary for us to share this information with Consulates, Embassies, Airlines, Hotels and other service providers who would be providing you service during the tour. We would also be constrained to disclose such information if we receive an order of the court, a requisition from any government or statutory authority, subpoena, or under any law, rules or regulations, such disclosure becomes necessary.

You agree to let us photograph and / or videograph the tour and specifically you agree to let us photograph and / or videograph you in the course of the tour. You consent to any such pictures being taken and agree that you hereby grant a perpetual, royalty-free, worldwide, irrevocable license to Travelxp,its affiliates and assigns, to reproduce for any purpose whatsoever (including marketing and promotions), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation to you or compensation payable to you.

You agree and accept that all such photographs and / or videgraphs and statistics are our absolute property and we have the unrestricted right to use them for any legitimate purposes including advertisement and commercial purposes. Further, you agree that if you share with us any photographs and / or videographs taken by you during the tour, we would be free to publish such photographs and / or videographs through all media including print media, websites, letters, emails etc.

12. Amendments and Severability:

The latest Terms, as amended, may be accessed any time on Travelxp’s website at, or will be sent to Client upon their written request to travelxp. If any provision of these Terms is found to be so broad as to be unenforceable, such provision shall be interpreted to be only so broad as is enforceable. The invalidity or unenforceability of any provision hereof shall in no way affect the validity or enforceability of any other provision.

13. Interpretation:

As to the interpretation of the aforesaid terms and conditions, our decision shall be final and binding upon you. We reserve the right to change the Terms & Conditions any time without any prior notice.
